The governments of Ecuador and Cuba signed an air services agreement in order to contribute to the progress of aviation in both countries.

In an official statement published by the Ministry of Transport and Public Works of Ecuador – MTOP learned about this signing of the agreement between both governments, with which it seeks to exploit commercial air activities between both countries with the highest degree of security and user protection.

What is stated in said agreement, that preserves the interests of both states, and that it respects current international legislation, highlights the following:

grant of rights:

  1. Each Party grants the other Party the following rights for the provision of international transportation services by the airlines designated by the other Party.
    • The right to overfly without landing on the territory of the other Party;
    • The right to make stops in said territory for non-commercial purposes;
    • The right to embark and disembark in the aforementioned territories, at specified points and routes, passengers, Baggage, cargo and airmail, separately or in combination, destined for or originating from points in the territory of the other Party, subject to the provisions contained in the Annex to this Agreement.
    • The right to embark and disembark in the territories of third countries, at the points, on the specified paths, passengers, Baggage, cargo and airmail, separately or in combination, destined for or originating from points in the territory of the other Party, subject to the provisions contained in the Annex to this Agreement.
  2. Nothing in this Article may be construed as conferring on the designated airlines of a Party the right of cabotage..

Designation:

  1. Each Party shall have the right to designate by diplomatic note the other Party, one or more airlines to operate the services agreed in accordance with this.

Denial:

  1. Each Party shall have the right to deny, revoke, cancel and/or suspend an operation authorization and the exercise of any of the rights specified in the Article 2 of this Agreement to the designated airlines of the other Party or to impose conditions on them.

Frequencies

  1. Each Party shall be entitled to fourteen (14) weekly frequencies, for passenger services, cargo and mail in combined or exclusive cargo form,
  2. The Aeronautical Authorities agree to review the increase in frequencies, according to market needs,
  3. Any increase in frequencies will be agreed directly between the Aeronautical Authorities, In accordance with article 23 of the Air Services Agreement

traffic rights

  1. The airlines designated by the Parties may exercise traffic rights of up to fourth freedom between the territories of both Parties for passenger services., cargo and mail separately or combined.
  2. Fifth freedom rights are authorized at the point of Panama.
  3. Fifth freedom rights in other points, will be subject to negotiation and approval by the Aeronautical Authorities of both Parties, through the consultation procedure, provided for in Article 23 of this Agreement,

Non-scheduled services

  1. The Aeronautical Authorities may authorize non-scheduled passenger and cargo services., complying with the regulations of each country.

Flights between Ecuador and Cuba

At the moment, the only flights that operate between these countries are cargo with Cuban Cargo, which operates up to two weekly flights (operated by the Colombian freighter LAS) from Havana with a stopover in Panama.

Regarding passengers, Tame EP stopped operating this regular route in June 2017, same year that Cuban Aviation requested traffic rights from Havana to Quito and Guayaquil, situation that prospered us, but now with this agreement it could once again form part of the international growth intentions of this airline, that thanks to the important migratory and tourist exchange, makes it a very interesting route, but maybe, later.
